METALWORKS SKATE PARK PROJECT

NOTICE IS HEREBY GIVEN by CITY OF FERNDALE that sealed bid proposals will be received by the City of Ferndale at the Public Works Department located on the second floor of Ferndale City Hall, 2095 Main Street, Ferndale, Washington, 98248, (360) 384-4006, until October 5, 2023, at 2:00 PM, and will then and there be opened and publicly read for the Metalworks Skate Park Project.  Prior to the bid proposal deadline, a Prebid meeting is scheduled on September 28, 2023, at 2:00 PM at Ferndale City Hall, 2095 Main Street, Ferndale, Washington, 98248, (360) 384-4006.  This meeting is not mandatory.

PROJECT DESCRIPTION: This Project will construct a new 10,000 square foot skate park off Second Avenue and adjacent to Phillips 66 Sports Complex, Pioneer Park, and Star Park in accordance with the Contract Documents for the project. Improvements will include retaining wall/wall seating, irrigation, benches, recycling and trash receptacles, landscaping, and associated utility improvements including stormwater facilities and pump station for drainage, as well as bid alternates for lighting, a shade structure, and installation of industrial relics as a landscaping feature for the new park.

Bid Guaranty

All bid proposals shall be accompanied by a bid proposal deposit in cash, certified check, cashier’s check, or surety bond in an amount equal to five percent (5%) of the amount of such bid proposal.  Should the successful bidder fail to enter into such contract and furnish satisfactory performance bond and payment bond both in an amount of 100 percent (100%) of the contract price within the time stated in the specifications, the bid proposal deposit shall be forfeited to the City of Ferndale.  All bidders and subcontractors shall have a contractor’s license to work in the State of Washington and a City of Ferndale Business License before starting work. All work performed on this project will be subject to prevailing state wage rates.

Maps, plans, and specifications are available for download on the City of Ferndale website at www.cityofferndale.org/metalworks.  Bidders must email public-works@cityofferndale.org to request to be added to the plan holders’ list.  Only those listed on the plan holders’ list will be contacted in the event that addenda are issued for the project.

The City of Ferndale, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. 2000d to 2000d-4) and the Regulations, hereby notifies all bidders that it will affirmatively ensure that in any contract entered into pursuant to this advertisement, disadvantaged business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of race, color, or national origin in consideration for an award.

The contractor, subrecipient, or subcontractor shall not discriminate on the basis of race, color, national origin, or sex in the performance of this contract. The contractor shall carry out applicable requirements of 49 CFR Part 26 in the award and administration of USDOT-assisted contracts. Failure by the contractor to carry out these requirements is a material breach of this contract which may result in the termination of this contract or such other remedy as the recipient deems appropriate, which may include, but is not limited to: (1) Withholding monthly progress payments; (2) Assessing sanctions; (3) Liquidated damages, or (4) Disqualifying the contractor from future bidding as non-responsible.
